Bobrisky challenges sentence; files notice of Appeal

Nigeria’s controversial cross-dresser, Idris Okuneye, popularly known as Bobrisky has a notice of appeal on Monday, opposing the maximum term of six months that the Federal High Court in Lagos had imposed on him.

The Economic and Financial Crimes Commission (EFCC) indicted Okuneye of four offences that involved the misuse of naira.

And before Justice A.O. Awogboro of the Federal High Court, Lagos, he entered a guilty plea.

On April 12, Bobrisky was sentenced to six months imprisonment without a fine option.

The judge stated during the convict’s punishment that the ruling ought to act as a warning to those who enjoy abusing and disfiguring the naira notes.

But Bimbo Kusanu, Okuneye’s attorney, filed a notice of appeal, pleading with the Court of Appeal to overturn the maximum punishment.

Kasanu is requesting that the Court substitute a fine of #50,000 for each count in place of the current punishment.

According to the counsel’s statement in the notice of appeal, he stated that the trial court gave his client who had no prior criminal convictions the maximum penalty.

He said that the provisions of the Administration of Criminal Justice Act (ACJA) could be used to give lighter sentences.

He claimed that the appellant received a harsh penalty from the trial court that went beyond the ACJA’s obligatory provisions.

According to the appellant, the trial court disregarded the appellant’s positive antecedent, which was that he spared the court’s time by entering a guilty plea.

According to him, the respondent’s initial invitation was accepted by the appellant.

He claimed that in sentencing the appellant, the trial court had not used its discretion in a prudent or judicial manner.

He also clarified that the appellant had suffered a miscarriage of justice as a result of this act.
